These Terms & Conditions ("Terms") govern your access to and use of the website, content, applications, and courses offered by Dynamic Stability Training B.V., also trading as "Dynamic Stability Systems", ("DST", "DSS", "we", "us", "our"). They also apply to any quotation, order, or invoice we send you. By using our website or apps, creating an account, or enrolling in a course, you agree to these Terms. If you do not agree, do not use our services.
Our Privacy Statement explains how we handle personal data and forms part of these Terms by reference.
In short. DST is a knowledge institute for human movement. We publish essays and frameworks, offer courses and training, curate a community of practitioners, and build movement-analysis technology and apps. Our content and courses are educational — they are not medical advice and do not create a practitioner–client or treatment relationship. Where you buy something from us, EU consumer law (including your right of withdrawal) applies. Dutch law governs these Terms. This summary is for convenience only; the full Terms below prevail.
Part A — Website, Content & Apps
1. Who we are and how to contact us
Dynamic Stability Training B.V., a private limited company incorporated under the laws of the Netherlands.
- Registered office: Steenstraat 19-05, 3961 VM Wijk bij Duurstede, the Netherlands
- Chamber of Commerce (KvK): 94632308
- VAT (BTW): NL866842809B01

2. Acceptance and definitions
By using our services you accept these Terms and our Privacy Statement. In these Terms:
- "Content" means all material we publish — essays, articles, frameworks, course materials, videos, images, and downloads.
- "App(s)" means any of our software applications or platforms — including our Dynamic Stability Systems movement-analysis tools and any current or future mobile or web apps.
- "Courses" means paid or free courses, training programmes, and educational offerings, whether online or in person.
- "Practitioner" means a movement professional listed in, or a member of, the DST practitioners community.
- "Services" means our website, Content, Apps, Courses, and community, collectively.
- We may offer our knowledge, essays, and Courses under the name Dynamic Stability Training, and our movement-analysis technology, systems, and product Apps under the name Dynamic Stability Systems. Both are operated by the same company and are governed by these Terms.
3. Eligibility and age
Our Services are intended for adults. You must be at least 18 years old (or the age of majority where you live) to create an account, make a purchase, or enrol in a Course. By using the Services you confirm that you meet this requirement.
4. Educational content — not medical advice
Our Content, Apps, and Courses are for educational and informational purposes only. They describe how the body organises movement and how to work with it. They are not medical, diagnostic, physiotherapeutic, or other professional health advice, and they are not a substitute for consultation with a qualified professional.
Using our Services does not create a practitioner–client, therapist–patient, or treatment relationship between you and DST. We do not diagnose, treat, or prescribe. You are responsible for how you apply what you learn.
5. Physical activity — consult a professional and assumption of risk
Some Content and Courses describe physical movement or exercise. Physical activity carries inherent risks, including injury. Consult a qualified physician or health professional before beginning any exercise programme, especially if you have a medical condition, are injured, or are pregnant. You participate at your own risk and are responsible for exercising within your own limits.
6. Accounts and security
Some Services require an account. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date. Tell us promptly at info@dynamicstability.training if you suspect unauthorised use. We may suspend or close accounts that breach these Terms.
7. Licence to use our website and Content
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use our website and Content for your own, non-commercial use. Except as these Terms allow or applicable law permits, you may not copy, reproduce, republish, distribute, sell, adapt, or create derivative works from our Content, nor use it to train machine-learning models, without our prior written permission. Reasonable quotation with clear attribution and a link is permitted.
8. Intellectual property and trademarks
All intellectual property in the Services — including the DST framework, essays, course materials, software, designs, logos, and trademarks — is owned by DST or its licensors and is protected by law. Nothing in these Terms transfers any such rights to you. You may not remove or obscure any proprietary notices.
9. Your submissions and feedback
If you submit content to us (for example comments, posts, or materials in a Course or community), you keep your rights in it but grant DST a worldwide, royalty-free, non-exclusive licence to use, store, reproduce, and display it for the purpose of operating and improving the Services. Do not submit anything unlawful, infringing, or that you do not have the right to share. Any feedback or suggestions you give us we may use freely, without obligation to you.
10. App and software licence
Where we make an App available, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use it for its intended purpose, subject to these Terms and any additional in-app or store terms. You may not copy, modify, reverse-engineer, decompile, or resell the App except where applicable law expressly permits.
- App stores. Apps obtained through the Apple App Store or Google Play are also subject to that store's terms. Where required, Apple/Google are third-party beneficiaries of these Terms with respect to that App, but the contract is between you and DST, not the store.
- Devices and availability. We may not support modified, jailbroken, or rooted devices, or outdated operating systems. We may update, change, restrict, or discontinue an App or its features, and we do not warrant that an App will be uninterrupted or error-free.
- Sensor and measurement technology. Data produced by our movement-analysis technology is provided for educational and analytical purposes and is subject to §4 (not medical advice) and §15–16 (warranties and liability).
11. Practitioners community and referrals
DST curates a community of movement professionals who work from our framework. If you are a Practitioner, additional terms apply:
- Membership and curation. Membership is by our acceptance and may require meeting and maintaining our criteria. We may decline, suspend, or remove membership at our discretion, acting reasonably.
- Conduct. You agree to represent the DST framework accurately, act professionally and lawfully, and comply with any community guidelines we publish.
- Independence and referrals. Practitioners are independent professionals, not employees, agents, or partners of DST. Where DST refers a person to a Practitioner, or lists a Practitioner, DST does not provide, supervise, or guarantee that Practitioner's services and is not responsible or liable for them. Any engagement is directly between the client and the Practitioner. Each Practitioner is responsible for their own qualifications, insurance, and compliance.
12. Acceptable use — prohibited conduct
You agree not to: break the law or infringe others' rights; upload malware or attempt to gain unauthorised access; scrape, harvest, or bulk-download Content except as permitted; disrupt or overload the Services; impersonate others; or use the Services to harass or harm anyone. We may suspend or terminate access for breach.
13. Third-party links and services
The Services may link to or integrate third-party websites, apps, or services (for example payment providers, app stores, or embedded media). We do not control them and are not responsible for their content or practices. Your use of them is at your own risk and subject to their terms.
14. Availability and changes to the Services
We aim to keep the Services available but do not guarantee uninterrupted access. We may change, suspend, or discontinue any part of the Services, and may perform maintenance, with or without notice. Where a change materially reduces something you have paid for, §16 and Part B apply.
15. Disclaimer of warranties
To the extent permitted by law, the Services and Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. This does not exclude rights you have as a consumer under Dutch or EU law that cannot be excluded.
16. Limitation of liability and indemnity
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or for fraud). Subject to that:
- All customers. We are not liable for indirect or consequential loss, including loss of profit, data, or goodwill.
- Consumers. Our total liability arising out of or in connection with the Services is limited to the amount you paid to us for the relevant Service in the 12 months before the event giving rise to the claim. Your mandatory statutory consumer rights are not affected.
- Business customers. Our liability for direct loss is limited to the price paid (excluding VAT) for the relevant Product or Service. All other liability is excluded, except in the case of intent or deliberate recklessness on the part of our management. You indemnify us against third-party claims relating to the Services, unless such intent or deliberate recklessness is established and you are not at fault.
Your statutory consumer rights are not affected.
17. Privacy and data protection
We process personal data in accordance with the GDPR/AVG and our Privacy Statement, which explains what we collect, why, the legal bases, sub-processors, retention, and your rights. Please read it — it forms part of these Terms.
18. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "last updated" date. Where a change is material, we will give you reasonable advance notice before it takes effect and, if you are a consumer, you may reject the change by ending your use of the affected Service before it takes effect; if you continue to use that Service after the change takes effect, the updated Terms apply. For Courses you have already booked, the version in force at the time of booking governs that booking.
19. Governing law, jurisdiction and language
These Terms are governed by the laws of the Netherlands. The competent court in the district of Midden-Nederland has jurisdiction, without prejudice to any mandatory consumer right to bring proceedings in your country of residence. The governing language of these Terms is English.
20. Miscellaneous
If any provision is held invalid, the rest remains in force. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor of our business. These Terms (with the Privacy Statement and any Course terms) are the entire agreement between us regarding the Services. Provisions that by their nature should survive termination (including §8, §11, §15, §16, §19) do so.
Part B — Courses & Enrolment
These terms apply in addition to Part A whenever you enrol in a DST Course. Where a specific Course has its own published terms, those apply on top of these.
21. The enrolment agreement
An enrolment agreement is formed when you complete the booking process and we confirm your place (or, for a waitlist, when we confirm you have moved from the waitlist to a booked place). We will make the essential Course details — content, format, dates, duration, and price — available before you book.
22. Enrolment, waitlists and confirmation
- Enrolment. You enrol by completing our booking process and providing accurate details. Places may be limited and are allocated on confirmation, not on expression of interest.
- Waitlists. Where a Course is full, you may join a waitlist. A waitlist place is not a booking and does not guarantee a place or a price. If a place opens, we will offer it to waitlisted people in order; you confirm and pay within the period we state, after which the offer may pass to the next person.
- Confirmation. Your place is confirmed once we accept your booking and, where payment is due upfront, once payment is received.
23. Prices, payment and billing
- Prices. Prices are as shown at the time of booking. For consumers, prices include VAT (BTW) where applicable; for business customers, prices may be shown excluding VAT. We may correct obvious errors.
- Payment. Payment is due as stated at booking — in full in advance, or in instalments where offered. We use third-party payment providers; their terms apply to the payment itself.
- Subscriptions / recurring payments. Where a Course or membership renews automatically, we will make the renewal terms clear before you buy, and you can cancel future renewals as described at §25 and in your account.
- Late payment (business customers). For business customers, overdue amounts may carry statutory commercial interest and reasonable collection costs. We may suspend access until payment is made.
24. Right of withdrawal (consumers) — 14-day cooling-off
If you are a consumer buying online, you have the right to withdraw from your purchase within 14 days without giving a reason. The period ends 14 days after the day the agreement is concluded (for services and digital content).
- How to withdraw. Tell us within the period by a clear statement — by email to info@dynamicstability.training or using the model form in Schedule 1. We will confirm receipt.
- Refund. We will refund all payments for the withdrawn purchase within 14 days of being informed, using the same payment method, unless you agreed otherwise.
- Services started during the cooling-off period. If you asked us to start a service during the 14 days and then withdraw, you owe a proportionate amount for what was provided up to your withdrawal.
- Digital content / courses that have started. Your right of withdrawal ends once online digital content or a Course has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal. We will ask for this consent before you get immediate access.
25. Cancellation, rescheduling and refunds
Separate from the statutory right of withdrawal above:
- Cancellation by you. You may cancel a booked Course on the following terms: more than 14 days before start — full refund minus a €25 administration fee; 7–14 days before start — 50% refund; fewer than 7 days before start or no-show — no refund. Where we can transfer you to a later date instead, we will try to.
- Rescheduling. We may offer to move your place to another date; any price difference may apply.
- Cancellation by us. If we cancel or reschedule a Course (for example too few participants, or circumstances beyond our control), you may choose a place on an alternative date or a full refund of amounts paid for that Course. We are not liable for incidental costs such as travel or accommodation.
- Force majeure. Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control — including illness, extreme weather, loss of venue, strikes, power or network outages, pandemics, or government measures. Where such circumstances prevent a Course from proceeding, the "Cancellation by us" terms above apply.
26. Access, duration and completion
We will make clear how long you have access to a Course and its materials. We may end access for serious breach of these Terms. Where a Course involves online materials, access is personal to you and subject to §7 and §28.
27. Certification and completion (where offered)
Where a Course leads to a certificate or recognition, we will state the requirements to achieve it. A certificate reflects completion of the Course only; it is not a licence to practise and does not make you an employee, agent, or endorsed representative of DST beyond what §11 provides.
28. Course materials — intellectual property and personal licence
Course materials are DST's intellectual property (§8). We grant you a personal, non-transferable licence to use them for your own learning. You may not share, resell, record, or redistribute them, or use them to deliver competing training, without our written permission.
29. Complaints and dispute resolution
We want you to be satisfied. If you have a complaint, contact us at info@dynamicstability.training and we will acknowledge it within 5 working days and aim to resolve it within 4 weeks.
If we cannot resolve it, the dispute may be brought before the competent Dutch court under §19.
